DEFENDED CASES |
| If a case becomes defended, all further work will be charged at the agreed hourly rate of £115.00 plus VAT per hour whilst the case remains within the Debt Collection department |
| All Small Claims cases will remain within the debt collection department and in a straightforward case should not exceed an additional 3 hours work which would include preparing your case for hearing and filing your documentation at Court and on the Defendant. |
| We do offer a Contigency fee service for Small Claims cases which we operate on a "no win, no fee" basis. If we are successful in obtaining Judgment in your case, we will charge you a % of the amount recovered. Further information can be provided on this service if required. |
| If a case is above £5000.00 and becomes too complex and therefore, requires the expertise of a qualified solicitor, the case will be transferred out of the Debt Collection department. Our solicitors charge out rates will depend on their experience. |
| If a Defence is filed which is simply a holding defence and shows "no real prospect of successfully defending the claim", the Claimant can make an application to the Court for Summary Judgment. The Court fee to make such an application is £60.00 and our charges are £235.00 plus VAT. Again, both of these are recoverable from the Defendant should the application be successful and our charges reflect the fixed costs that can be recovered. |
